1. Parties and Activities
This Participant Waiver, Release of Liability, and Assumption of Risk ("Agreement") is entered into by the undersigned participant ("Participant") and, if Participant is under 18, the undersigned parent or legal guardian ("Parent/Guardian"), in favor of Arm Hang Challenge LLC, a North Carolina limited liability company (the "Company").
"Activities" means the Arm Hang Challenge (hanging from an overhead bar for time), the Clock Push-Up Challenge (performing push-ups on a clock mat for time), any warm-up, practice, or attempt, and all related events, set-up, and time spent at or near an event site, at any date and location where the Company operates.
2. Released Parties
"Released Parties" means the Company and its members, owners, managers, officers, employees, independent contractors, judges, volunteers, and agents; every business, bar, venue, property owner, landlord, nonprofit, or other host of an event where the Activities take place; event sponsors; and the successors and assigns of each of them.
3. Voluntary Participation
Participant's participation is completely voluntary. Participant may decline to participate, and may stop any attempt at any time, for any reason, without penalty other than forfeiting that attempt. Participant agrees to stop immediately if Participant feels pain, dizziness, shortness of breath, chest discomfort, or any other warning sign.
4. Known Risks
PARTICIPANT UNDERSTANDS THAT THE ACTIVITIES ARE PHYSICALLY STRENUOUS AND INVOLVE INHERENT AND OTHER RISKS OF SERIOUS INJURY, PERMANENT DISABILITY, AND DEATH, AND OF PROPERTY DAMAGE. These risks include, without limitation: falls from the bar or loss of balance; grip failure and sudden release; landing on hard, uneven, wet, or slippery surfaces; muscle, tendon, and ligament strains, sprains, and tears; shoulder, elbow, wrist, or finger dislocation, separation, or fracture; blisters, calluses, skin tears, cuts, and abrasions; dizziness, fainting, or loss of consciousness; heat exhaustion or dehydration; heart attack, cardiac arrhythmia, stroke, or other cardiovascular events; aggravation of pre-existing conditions; failure, movement, or collapse of the bar, frame, mat, timer, or other equipment; outdoor conditions, darkness, and weather; crowds, spectators, traffic, and the conduct of other people; the effects of alcohol or other substances consumed by Participant or others; and the acts, omissions, or ordinary negligence of the Released Parties or others.
5. Assumption of Risk
PARTICIPANT KNOWINGLY AND VOLUNTARILY ASSUMES ALL OF THE RISKS DESCRIBED ABOVE AND ALL OTHER RISKS OF THE ACTIVITIES, WHETHER KNOWN OR UNKNOWN, FORESEEABLE OR UNFORESEEABLE, INCLUDING RISKS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.
6. Fitness and Sobriety Statement
Participant states that Participant is in good physical health and is fit to take part in the Activities; that Participant has no heart condition, high blood pressure, recent surgery, injury, pregnancy, or other medical condition that makes strenuous exercise unsafe, and has not been advised by a medical professional to avoid such exercise; and that Participant is not under the influence of alcohol, drugs, medication, or any other substance to a degree that impairs Participant's judgment, balance, coordination, or safety. Participant will tell a judge before attempting if any of these statements is not true. The Company may refuse or stop any attempt at its sole discretion, including if it believes Participant appears impaired or unfit.

This release does not apply to claims arising from a Released Party's gross negligence, or willful or wanton conduct, or to any claim that cannot be waived under North Carolina law.
8. Covenant Not to Sue
PARTICIPANT AGREES NOT TO SUE OR BRING ANY CLAIM AGAINST ANY RELEASED PARTY FOR ANY CLAIM RELEASED IN THIS AGREEMENT.
9. Indemnification
Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, losses, damages, judgments, costs, and expenses, including reasonable attorneys' fees, brought by Participant or by anyone on Participant's behalf, or arising from Participant's breach of this Agreement or Participant's own conduct, except to the extent caused by a Released Party's gross negligence or willful or wanton conduct.
10. Medical Treatment Consent
Participant authorizes the Company and its staff to call emergency services and to obtain first aid and emergency medical care and transport for Participant if they believe it is needed. Participant understands the Released Parties are not medical providers and have no duty to provide medical care. Participant is solely responsible for all costs of any medical treatment and transport.
11. Photo, Video, and Name Release
Participant grants the Company and its licensees the irrevocable, worldwide, royalty-free right to record, photograph, and film Participant's attempt and presence at events, and to use Participant's name, first name, image, likeness, voice, attempt time, and results in any media, including social media, websites, advertising, and marketing, without compensation, approval, or further notice. Participant may ask the Company in writing to stop using a specific post going forward, and the Company will make reasonable efforts to honor that request.
12. Rules, Judging, and Prizes
Participant agrees to follow all posted and verbal rules and judge instructions. The judge's decisions on timing, form, valid repetitions, "NO REP" calls, disqualification, and winners are final. Entry fees are non-refundable once an attempt begins. Prizes are awarded only for a completed attempt that meets the posted rules, as determined by the judge, in the amount posted at the event. The Company may change, suspend, or cancel any challenge, rule, or prize at any time. Participant is responsible for any taxes on prizes.

To the fullest extent permitted by law, the Parent/Guardian also signs this Agreement on behalf of the minor.
THE PARENT/GUARDIAN AGREES TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, LOSSES, COSTS, AND EXPENSES, INCLUDING REASONABLE ATTORNEYS' FEES, BROUGHT BY OR ON BEHALF OF THE MINOR ARISING FROM THE MINOR'S PARTICIPATION, except to the extent caused by a Released Party's gross negligence or willful or wanton conduct. The Parent/Guardian consents to medical treatment for the minor under Section 10 and accepts responsibility for its cost.

This Agreement is governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any lawsuit relating to this Agreement or the Activities must be brought only in the state or federal courts located in or for Pitt County, North Carolina, and the parties consent to that venue and jurisdiction.
